Jewelry Cont'd From Page 1 positively identify a pendant recovered from a local pawn shop. He also stated the same thing on the stand, noting he would have to have an appraisal form for positive identification. On cross examination, ALFA attorney Michael Beers produced an appraisal filed with the insurance company when the pendant was insured. After comparing the pendant with the appraisal, Clements said it was the one he made for Self. Clements said diamonds have what he termed fingerprints, which are noted in the appraisals in the form of clarity and color.

Earlier in the day, David Long, who had pawned the pendant, testified it was a from a "young lady" who he couldn't identify. Long said he had known the girl a "week or two," but he couldn't remember her name and he didn't know why she had given him the pendant. Long was indicted on a charge of receiving stolen property in connection with the pendant, however, the case was reportedly not pursued because Patsy Self said she couldn't positively identify it. The same was true for an indictment against Joe Long, David's brother, who had pawned some silverware matching the type the Selfs had reportedly owned. Both Longs testified that while they had been to the Self's home at times, they had never entered the home at any time.

They said they had been to the residence helping their brother-in-law, Jimmy Austin, do yard work and other odd jobs. Austin had been the handyman for the Selfs and had been given the code needed to arm and disarm the alarm system at the residence. The jury heard a secretly recorded tape Friday morning containing a conversation between Austin, ALFA Investigator Ralph Newell and Investigator Rodney Brown. Newell testified the conversation occurred at a local motel after Austin called his Gainsville, office and said he wanted to talk about the Self fire. Austin told Newell and Brown he had heard a conversation about storing some items in a barn and told Newell he should also check out storage facilities in the Birmingham area.

During cross examination, Newell admitted he considered Austin a "liar" and that that was one reason he taped the conversation. "I didn't trust Jimmy Austin. I still don't trust Jimmy Austin," he said. "I had no intentions at all of using this tape," said Newell when questioned about the secret recording. He stated he felt it was necessary to use it for his protection after Austin accused him of wrongdoing.

8-12 Reagan won't testify in North trial From wire reports WASHINGTON Former White House aide Oliver L. North's defense that he carried out administration orders by covering up his work for the Nicaraguan Contras was crippled when a federal judge refused to compel former President Reagan to testify. In denying a request to call Reagan as a defense witness in North's trial, U.S. District Judge Gerhard A. Gesell said Friday he couldn't find any evidence that the former president authorized North's activities.

trial record presently contains no proof that defendant North ever received any authorization from President Reagan to engage in the illegal conduct alleged, either direct- the first claim and the Selfs dropped the second. The testimony in the trial is expected to conclude Monday and possibly go to the jury as early as Monday afternoon, according to Judge Stewart. Deerman said he was concerned that sometime in the future something may go wrong with the system and needed parts would not be available. "My concern is that any problem we have now," said Deerman, "will make a miserable life for a rec director to please the public.

If there is anything not up to par, the city and the rec director are going to catch it." Holder told the committee that the piece of equipment in question was a dehumidifier and had nothing to do with water filtration. Hammer said that a final decision on the pool's filtration system had not been reached and would be discussed further. In response to the committee's questions, Mullins said he didn't feel the city has been "shortchanged" but did say he would endeavor to have professional architect on the construction site more frequently. ARREST The Self's neighbor, Kenneth "Happy" Thompson, testified Friday that he and Nolan Self had exchanged house keys, at one time, so they could watch each other's homes when the other was out of town.

Joe Long was also connected with a possession of Nolan Self's by a witness who testified Long brought a prescription issued to Nolan Self to a local pharmacy. Bobbie Smith Wade, an employee of Big Pharmacy, said she had grown up with Joe Long and recognized him when he wanted the prescription refilled. "I asked him if Nolan was sick," said Wade, adding that Long responded, "No. I just work for ALFA filed suit against the Selfs following the March 9, 1987 fire. "The evidence obtained by the plaintiff indicates that the said defendants have violated the terms of the policy of insurance by materially misrepresenting the extent of their damages," states part of the suit.

Testimony earlier in the week revealed investigations by the State Fire Marshall's office and Newell investigations concluded the fire was intentionally set using mineral spirits. No one has been charged in the case. The suit filed by ALFA in June, 1987 also stated, "The investigation by the plaintiff leads also to the conclusion that the defendants conspired to have the dwelling intentionally set afire." The Selfs then filed counter suits claiming breach of contraci and bad faith and slander and libel. Judge Donald Stewart dismissed Cont'd From Page 1 came to his assistance. Reagan, in Los Angeles where he now lives, said Friday he had been determined fight any attempts to force him to testify. "I made up my mind I wasn't going," would Reagan told KESQ-TV. "I have set a precedent that the next president doesn't have a right to impose on other presidents. No president has ever been subpoenaed." Reagan would have been the first former president to be compelled to testify in a criminal proceeding concerning his conduct while in office had Gesell agreed to make him appear. The defense is scheduled to begin presenting its case Monday, the seventh week of North's trial.

Defense attorney Barry Simon refused to identify the first witness. The prosecution had put on 29 witnesses, and on Friday the judge denied a defense motion to dismiss remaining counts against North. The defense argues that North was simply following Reagan's orders when he lied to Congress in 1985 and 1986 about the National Security Council's involvement in helping the Nicaraguan Contras. North's attorneys had subpoenaed Reagan so they could ask him what he knew about the NSC's role in raising money for the Contras at a time Congress had barred U.S. military assistance to the rebels.

The judge said he reached his decision about Reagan's testimony after studying the trial record, thousands of pages of classified and unclassified documents, portions of Reagan's personal diaries and written answers Reagan provided to the grand jury. Theodore B. Olson, Reagan's personal attorney, said he was pleased with the order. Simon declined comment. The Justice Department had opposed Reagan's court appearance on the grounds it could have opened the door for questioning about sensitive national security matters.

Gesell acknowledged there is public interest" in what Reagan "may have known or may have done." But he said North's trial does not involve such a broad inquiry.
